UPDATE: One arrested in Northwest Rochester shooting


Police have made an arrest after shots were fired Tuesday night in a Northwest Rochester neighborhood.

The Rochester Police Department responded to a residence at 1800 43rd Street NW on a report of shots fired around 9:30 p.m. Tuesday. Three boys, ages 15, 13, and 8 were all inside the home as the bullets penetrated the walls.

Police said a vehicle in the driveway had multiple bullet holes in it and there were shell casings from a semi-automatic rifle in the driveway and sidewalk area around the home.

The boys' father told officers he believed he knew who did the shooting, in relation to a dispute earlier in the day at the Holiday gas station on 7th Street Northeast and North Broadway Avenue. The victim said he was threatened with a handgun over a dispute involving money and a stereo.

About two hours after the shooting, at about 11:15 p.m., police arrested Joshua Tucker Cunningham, 39, on the 10th block of 11th Street NE. Police said he had a handgun at the time he was arrested.

The shots fired in the incident were from a semi-automatic rifle, but the gun has not yet been found.

Cunningham is expected to appear in court Thursday. He is a convicted felon, so he faces at least one charge of felony possession of a firearm.

The investigation is ongoing and police say more charges are likely.
