ROCHESTER, Minn. (KTTC) -- Charges have been filed against a man suspected of firing a gun in the Rochester Perkins south parking lot early Sunday morning.
Carlos Rivera, 21, of Rochester, is charged with one count each of: dangerous weapon drive by shooting, second-degree assault, reckless discharge of a firearm, second-degree riot and disorderly conduct.
According to a criminal complaint, a man was eating at Perkins on South Broadway early Sunday morning. When he went to the parking lot, he said three men jumped him and one started shooting at him. He wasn't hit but told police he dove to the ground and pretended to be shot.
The complaint says Rivera and two other suspects drove away. Police caught up with them and arrested Rivera. Officers also arrested 21-year-old Diego Giron.He's charged with 2nd degree riot and disorderly conduct.
A third young man, a juvenile, was also arrested.
