Mason City man files Iowa Supreme Court appeal

MASON CITY, Iowa (AP) -- A 42-year-old man convicted of killing another Mason City man in 1998 has appealed his case to the Iowa Supreme Court.

The Mason City Globe Gazette says (http://bit.ly/13LkFtC) Michael Weatherspoon is appealing a district court ruling.

Weatherspoon was convicted of stabbing 55-year-old Jerry Dean on March 4, 1998, in Dean's room at the Willow Inn Motel. They were arguing over payment to an exotic dancer.

Weatherspoon said at his trial that he acted in self-defense and that Dean was mentally ill and violent. His appeal says the trial judge wouldn't let Dean's psychiatrist testify.

The district court ruling earlier this month says that even if Weatherspoon had Dean's mental health records, it would not have affected the jury's deliberations or verdict.

Weatherspoon is serving a life sentence.
