Investigator finds neglect by Adams Health Care Center in man's death

ST. PAUL/ADAMS (KTTC) -- A Minnesota state health investigator has found that a nursing home in Adams is guilty of neglect in the death of a resident last March 18.

The Star-Tribune is identifying the resident as Wayne Bye, 90, of Austin.

Investigator Suzette Miller made a surprise visit to the Adams Health Care Center last April 5, according to a report filed with the Minnesota Department of Health.

After interviewing seven nursing home staff and six residents, Miller concluded the staff did not properly supervise the elderly man while he was eating.  He choked on fruit... stopped breathing... and turned blue.  Bye was fighting pneumonia when it happened.

His wife was there and ran for help.  But because a "do not resuscitate" order was in place, nursing home staff did not try to revive him.

The Adams Health Care Center has the right to appeal the investigator's finding.  Miller, in her report, did not name any of the nursing home staff as being specifically responsible for what happened.
