Appeal filed in case of slain ND college student


FARGO, N.D. (AP) -- Lawyers for a man sentenced to death for killing a University of North Dakota student have submitted a 298-page document for what is considered the final step in the legal appeals process.

The so-called habeas corpus motion was filed in federal court Tuesday for Alfonso Rodriguez Jr., convicted of kidnapping resulting in the death of Dru Sjodin. Rodriguez is being held on death row at a federal prison in Terre Haute, Ind.

Sjodin, from Pequot Lakes, Minn., was abducted from the parking lot of a Grand Forks shopping mall in November 2003. Authorities say she was raped, beaten and stabbed.

It was the state's first federal death penalty case and resulted in tougher laws for sex offenders.

Rodriguez lost earlier appeals and was denied a U.S. Supreme Court hearing.
