Lee guilty of first degree manslaughter


ROCHESTER, Minn. (KTTC-DT) -- Just after 8:30 p.m. Thursday, a jury wrapped up their deliberations in the murder trial of 27-year-old Joshua Lee.  Lee is one of two men accused in the 2008 beating death of Muhadin Mumin.  Here is the jury's decision:

Manslaughter in the first degree, guilty.

Murder in the second degree, not guilty.

5th degree assault, guilty.

3rd degree assault, not guilty.

During closing arguments Thursday afternoon, the Prosecution looked to discredit the defense's assertion that cocaine and alcohol caused Mumin's death by recapping surveillance video in detail.  Also saying the video shows Mumin standing still and then falling back from an apparent hit from co-defendant Adam Brandup.  Then being chased, thrown to the ground and then kicked by Lee.  The Prosecution says the 12 second assault left Mumin unresponsive, ultimately causing a fatal heart arrhythmia.

The Defense denied Lee's involvement in the assault on Mumin.  They say the video shows Brandup solely attacking Mumin.  The Defense also put heavy weight on the cocaine and alcohol in Mumin's system as a possible cause of his death.

Joshua Lee is due back in court for sentencing March 2.  He faces 78 to 128 months in prison if sentenced to the full extent.

Lee is not being taken back into custody.
