Recount lawsuit success unlikely

Election law experts say the GOP likely would fail if it tries to sue its way to victory with a legal challenge to the recount in the Minnesota's governor's race.

Barring some big surprise, the recount gives Republican Tom Emmer only a long shot at wiping away Democrat Mark Dayton's 8,750-vote lead and claiming the governor's office.

The Secretary of State's office hopes to wrap up the recount process Dec. 14.

But either side would then be free to challenge the result in court.

Edward Foley, a law professor at Ohio State University, is among the election law experts following the race who say they haven't seen anything to provide sufficient legal grounds for a lawsuit to succeed.

Republicans would need to document enough violations to change the outcome.
